Donald
M. Bernstein, an attorney admitted to practice law in the
States of New York, New Jersey and Illinois, has been practicing
law since May 1980. He has tried dozens of cases in the
state and federal courts in New York, and other states.
He
obtained one of the largest decisions issued by the American
Arbitration Association in New York, which was in excess
of $24 million against the Western Union Company for breach
of a long term telecommunications lease for transmission
facilities. Mr. Bernstein has handled a wide range of complex
real estate related litigation matters, construction disputes,
real estate brokerage commission litigation, title disputes,
commercial landlord tenant proceedings and corporate dissolutions
among others.
He has argued dozens of appeals in state and federal courts
and a decision on an appeal he argued before the New York
Court of Appeals in 1997 stands as the seminal decision
in the State of New York on a procedural litigation device
and on the distinction between an “indemnification”
and a “guaranty” under New York law.
Mr. Bernstein also appears regularly before the New York
State Liquor Authority on liquor license revocation proceedings,
and lectures to lawyers at the New York City Bar Association
on liquor license issues. He is a member of the Bar Association
of the City of New York, and a member of its Hotels and
Hospitality Committee.
